The following conditions apply to the sale of materials or equipment, and to the hire, servicing of repair of goods supplied, repairs or serviced by Real Oak Floors. Hereafter called 'the company'. No alterations or additions to nor exclusion of any part of these conditions shall be valid in law unless specifically agreed in writing by a director of the company. Nothing in the Buyer's Terms of purchase shall override, cancel or modify any of the Company's Standard Conditions of Trade.
Our acceptance of your order by delivery of the goods constitutes a legally binding contract between the buyer and the company on these terms and conditions.
"Buyer" herein shall include the buyer, hirer, lessee, owner or any other person who is in charge of goods supplied by the company. 'Goods', shall include materials, equipment, spare parts and any other item supplied, serviced, repaired, loaned or hired by the Company.
Charges for goods and services supplied by the Company shall be paid in full on or before delivery or completion unless the Buyer has an account with the company. An application for the opening of a credit account with the Company shall include an undertaking by the applicant that he/she has read and agreed to the Company's Standard Conditions herein. Where the buyer has an account, payment shall be made by 30 days from the month end. The company may at its absolute discretion close the Buyer's account at any time and any balances due shall be paid immediately by the Buyer to the company.
The price payable for goods ordered is set out on our website and in the showroom at the time of ordering. Upon agreement of contract between the buyer and the company these prices are non negotiable.
The property in and title to goods supplied by the company shall remain within the company until:
In the event of non-payment of sums due to the company from the buyer, the company shall be entitles to enter the buyer's Premises and to physically re-posses and remove there from similar goods supplied by the company for which payment has not been received. It will be assumed that where the buyer purchases similar goods from the company on a regular basis that a stock rotation system had operated and goods still held relate to invoices still outstanding for which full payment plus VAT hasn't been made.
It is the responsibility of the buyer to examine goods supplied by the company and to identify defects in materials and/or workmanship which might cause damage or injury. Illustrations, descriptions, weights and measurements shall be taken by the buyer as a guide only, and are not binding in detail. The company reserves the right without notice and without affecting the validity of the contract to make such changes in materials, dimensions and design as are reasonable and desirable. No claims for damages / discrepancies can be made after installation as installation of our materials constitutes acceptance of the product in its current state.
While the company endeavours to hold sufficient stock to meet all orders, if insufficient stock is held or the stock item has been discontinued, the company may, at its discretion, supply or deliver a substituted product or refund the buyer for such goods as soon as possible.
Where assembly of the goods supplied by the company is not undertaken by the company the buyer shall be responsible for assembly in accordance with the company's instructions and shall ensure that such instructions have been obtained from the company. Failure to assemble goods in the manner prescribed in the instructions supplied with goods will invalidate the Company's responsibility for damage caused to or by the goods.
Advice, information and opinion given by any Director, Employee or Agent of the company is given without legal responsibility. Any recommendations or suggestions made by the company relating to the use of goods, whether in technical literature or in response to a specific enquiry is made in good faith, but it is for the buyer to satisfy himself of the suitability of the goods for his particular purpose, and shall be deemed to have done so.
The company shall not be liable for damage or injury caused by its goods or workmanship beyond replacement of goods or work verification of the buyer's complaint. The company shall not be liable for any consequential loss caused by its failure or delay in supplying, servicing or repairing goods, whether the loss arises from the actions or from the omissions of the company, its employees, agents or subcontractors.
Important: All goods must be checked upon delivery and should not be signed for until you are happy that the order is correct and in good condition. Goods will be delivered to the given delivery address between the hours of 9am and 5pm Monday to Friday. You must ensure that there is someone available to take collection during these hours as the delivery will be taken to your door – not inside the house.
All times and dates for dispatches and deliveries quoted are estimates and not binding on the company. Time will not in this respect be of the essence of the contract. Times given are on a best endeavours basis and are subject to force majeure. Claims by the buyer for shortages or non-delivery must be made to the company within seven days of the delivery date. Claims for damage of goods during transit must be noted on the couriers delivery form and signed as damaged upon receipt and notification should be made to the company within seven days of receipt of the goods.
Any goods returned undamaged / incorrect will incur a 25% restocking fee and delivery costs are non refundable. Further delivery costs may be incurred if the undamaged / incorrect items need to be collected by ourselves.
Refunds can take up to 28 days to process.
Guarantees given shall not be applicable outside the UK unless expressly stated otherwise by the company in writing. Any guarantees given will be invalidated if the goods supplied by the company are subject to misuse or accidental damage after the buyer had taken delivery of them.
It is advisable that you do not book a flooring fitter until you have had the delivery of the goods to ensure your wood is left to acclimatise. Damage caused to and by goods which are fitted without consideration for acclimatisation can not be compensated for by the company.
Drawings, photographs, part numbers, layout and style are considered the property of the company. Reproduction in whole or in part is strictly prohibited without written permission. Quantities and measurements are approximate. Trademarks are acknowledged as being the property of their registered owners. Exact products may vary from that shown; all products are subject to availability. Goods are not sold on a trial basis.
Owing to the nature of digital photography and other such media, the products shown on this website and in any accompanying media may differ slightly in proportion and colour. Our products are derived from natural sources and so are subject to natural variations in colour, shade and general appearance.
The company reserves the right to suspend further supply or delivery, stop any goods in transit or terminate contract by notice in writing to the buyer should the buyer breach and obligation hereunder or become unable to pay any owed amount as the become due. Upon termination, your indebtedness to the company becomes immediately due and payable and the company shall be under no further obligation to supply goods to the buyer.
